RE-SIGN AND REFERRAL PROCEDURES

 Effective February 4, 2021

  1. All applicants for employment shall have their name placed on the appropriate out-of-work book. This must be filled out completely in ink and signed by the applicant.
  1. The Administrator shall evaluate the application and place the applicant in the highest Group for which he qualifies in accordance with the Labor Agreement. The Administrator shall mark the Group Number on the "Registration Application" with the date so noted, and sign his name in the appropriate space.
  1. The applicant shall sign the appropriate "Out of Work" Group Book and list the date, his address and phone number. He shall likewise print his name, following his signature.  The applicant shall be advised of his Group Number and his position within that Group.  Applicants placed in Groups 2, 3 and 4 shall be further advised that Referrals will be made from Groups 1, 2, 3 and 4 respectively as long as there are applicants for employment in the higher Groups.
  1. The Administrator will allow applicants to sign the "Out-of-Work Books" for employment between the hours of 8:00 am - 4:30 pm, Monday through Friday, excluding Holidays.
  1. Applicants must re-sign monthly. Re-sign shall be required between the 10th and the 16th of every month.

   

Re-sign notices will not be accepted in any manner later than the date required.

 Re-sign request must include the following information:

Applicant’s full name (first, middle, last)

Applicant’s address

Home Local number

IBEW Card # or if not a union member, then a Driver’s license or Government ID

Original sign-in date

“Re-sign” must be noted in the reference/subject line

  

  1. Employer request for manpower will be recorded on the Job Line (920-739-9408, Ext. 26) daily by 5:00 pm. A brief description of the nature of the call will be provided stating the name of the employer, the start date, the number of positions available and the anticipated duration (if available).  If there are no calls for manpower that day, a message to that effect will be on the recorder.

 

If you are interested in a referral for any of the jobs, at the conclusion of the recorded information you can leave a voice message on the job line or send an email to office@ibewlu577.com stating your name, your card number, your job preference(s) and a phone number where you can be reached the next morning.

At 9:00 am on the next business day, the job line will be turned off.  All respondents will be ranked according to their position on the “Out-of-Work” list and will be called in this order by 12:00 pm (noon) on that day.  We will call you at the number you left on the recorder or in the email.

All respondents who have not been contacted by 12:00 pm (noon) on that day can assume that their referral position was not high enough to be issued a referral.  Any new work calls or unfilled calls will be put on the job line for referral the following day.

The Business Manager is responsible for filling calls in a timely manner as needed by employers. Emergency referrals may have to be made outside normal hours using whatever means are available to fill calls.

Any regular job referred to someone below you on the Out-of-Work list is considered a refusal by all those above them on their respective book (i.e. Book I, Book II, etc.). Applicants shall have the right to refuse two (2) referrals.  Refusal of more than two (2) referrals will result in the applicant automatically being removed from the  list.  Applicants so removed, must then re-sign in person.  Specialty work and short calls will not be considered refusals.

An applicant who is rejected for employment by the Employer shall be replaced in his/her original position on the "Out-of-Work Book" and be referred to the next Employer.

 The Administrator shall remove from the list, the name of any applicant who accepts a referral, but fails to report for work or who then decides to turn down the job, and so note these facts on the back of the applicant's "Registration Application". The applicant will be required to re-register in person.

Short calls:

 Referrals for employment defined by the Employer as having duration of ten (10) days or less, weekends and holidays excluded, will be distributed by calling successively through the “Out-of-Work List” to fill the manpower request.

An individual called for a “short call” will not be eligible for additional “short calls” until the entire “Out- of-Work List” on which he is signed has been exhausted and his name comes available in the succeeding rotation.

 Individuals refusing short calls will not be assessed a refusal as described in Section 8 above.

 While employed on a “short call” an individual will not be eligible for alternate calls for employment.  

 The Administrator shall remove from the list, the name of any applicant who accepts a referral, but fails to report for work or who then decides to turn down the job, or is returned by the employer for cause within 10 business days and so note these facts on the back of the applicant's "Registration Application".  The applicant will be required to re-register in person.

  1. A request for Special Skills by an Employer will only be considered if it is in writing and signed by the Employer. The request must contain the name and location of the job, the Special Skill involved and the approximate duration of the Special Skills portion of the job. If the Special Skills request is considered, it will be with the express condition, in writing that the man will be terminated when the Special Skills portion for which he was hired is completed.
  1. Foreman Call-Out by Name: An Employer shall have the right to call foreman by name providing the following conditions are met:
  2. The employee has not quit, or been discharged-for-cause by, his previous Employer within the last thirty (30) days.
  3. The Employer shall notify the Business Manager in writing of the name of the individual being requested for employment as a foreman. Upon such request, the Business Manager shall refer said foreman provided his name appears on the highest priority group.
  4. When an individual is called as a foreman he must remain as a foreman for a minimum of one-thousand (1,000) hours or receive a reduction-in-force termination.
  1. Employee Call-Out by Name: An employer shall have the right to recall by name any former employee that the employer has laid off, provided:
  2. The former employee is properly registered on the Out-of-Work List regardless of his or her position on the list;
  3. The former employee has worked for the employer requesting the recall within the last six (6) months (except for a short call), as determined by the date that the former employee signed the Out-of-Work List;
  4. The former employee has not quit another employer, within the last month, since his or her last layoff from the employer making the recall request;
  5. The recall shall apply to Group I applicants registered on the Out-of-Work-List first. Group II, III, and IV recall will only be allowed if the request for manpower was offered to all Group I members registered on the Out-of- Work List;
  6. If an employer would layoff its workforce including the Shop Steward, and request manpower within two (2) weeks, the first applicant referred would be the former Shop Steward;
  7. New signatory employers signed within the last two (2) years with two (2) employees or less may hire their next two employees by name from the Out-of-Work List. The next applicant hired must come from the Out-of-Work List.
  1. Any applicant who is engaged in pre-approved organizing activities on behalf of the Local Union shall have their position on the “Out of Work Book” maintained as long as the applicant continues his organizing activity.
  1. Any Individual receiving two (2) discharges “for cause” in any twelve (12) month period, shall be suspended from future referral privileges until they appear before the Appeals Committee for a determination as to their continued eligibility for referral.
  1. The Labor Agreement provides for an "Appeals Committee" to be established and is to be composed of one (1) member appointed by the Union, one (1) member appointed by the Employer, and a Public Member appointed by both these members. It shall be the function of the "Appeals Committee" to consider any complaint of any employee or applicant for employment arising out of the administration by the Local Union of Article XIII of the Inside Construction Agreement.  The "Appeals Committee" shall have the power to make a final and binding decision on any such complaint, which shall be complied with by the Local Union.

 

The "Appeals Committee" is authorized to issue procedural rules for the conduct of its business, but it is not authorized to add to, subtract from, or modify any of the provisions of this Article XII, and its decision shall be in accord with this Article XII.  The following are the members of the "Appeals Committee".
